Selected Cases:

Lead and second-chair defense attorney in jury and non-jury cases involving a variety of issues, including Jones Act seaman claims, longshore third-party claims, Longshore and Harbor Workers' Compensation Act claims, collision cases, salvage cases, cruise line passenger cases and product liability cases. Representative cases include:

·          Dismissals for lack of personal jurisdiction granted by various state and federal courts to clients  

            Carnival Cruise Lines, Norwegian Cruise Lines and Royal Caribbean Cruise Lines.

·          Union Pacific RR Co. v. Inchcape Shipping Services, et al., U.S. District Court for Eastern District of

            Missouri, 2004. Court granted summary judgment for client in train derailment case.

·          Fisher International Freight Forwarders v. Hyundai Merchant Marine (America) Inc., U.S. District

            Court for Northern District of Illinois, 2001. Client dismissed on time bar issue.

·          Lindle v. Inland Lakes Management, Inc., Court of Common Pleas for Cuyahoga County, Ohio, 1997.

            Judgment for client at conclusion of plaintiff's case. Appeal by plaintiff dismissed for late filing.

·          Whyte v. Canada Steamship Lines, Court of Common Pleas for Cuyahoga County, Ohio, 1996. Death

            of Canadian seaman on Canadian vessel in U.S. waters. Verdict against client reversed on

            appeal, finding U.S. law did not apply - 1997. Ohio Supreme Court refused to hear plaintiff's

            appeal.

·          Perpich v. The Cleveland-Cliffs Iron Co. and The Interlake Steamship Co., U.S. District Court for

            Eastern District of Michigan, 1996. Summary judgment for clients in seaman's hearing loss

            case on statute of limitations issue.   Issue of judge's recusal reported at 927 F.Supp. 226 (E.D.

            Mich., 1996).

·          Ahmed v. Inland Lakes Management, Inc., U.S. District Court for Eastern District of Michigan, 1993.

            Defense verdict in Jones Act seaman's case.

·          Kurczewski v. Inland Lakes Management, Inc., U.S. District Court for Eastern District of Michigan,

            1992. Verdict in favor of Jones Act plaintiff, damages held to $50,000. (2nd chair)

·          Hawkins v. The Interlake Steamship Company, U.S. District Court for Eastern District of Michigan,

            1992. Verdict in favor of Jones Act plaintiff, damages held to $50,000.

·          Mowles v. Digicon, U.S. District Court for Southern District of Texas, 1987. Judgment for client

            when plaintiff failed to prove the spud which plaintiff's vessel struck came from client's vessel.

·          Pellerin v. Lykes Bros. SS. Co., Inc., U.S. District Court for Southern District of Texas, 1985. Defense

            verdict in Jones Act seaman's case.

·          Andress v. Sun Line Cruises, 101st District Court of Dallas County, Texas, 1984. Judgment for client

            on passengers' claim that accommodations on cruise ship were not what they had been

            promised.

·          Empacadora del Norte, S.A. v. M/V Finnco Victoria, 1983 A.M.C. 1235 (S.D. Tex. 1982). Represented

            plaintiff seeking salvage award for assisting burning cargo vessel.
