Representative Trials:

·          Smith v. Interlake Steamship Co., N.D. Ohio, 1995 and 1996 (with Mrs. Kelly): Represented

            shipowner in defense of Jones Act claims on trial and re-trial. Judgment on adverse verdict.

            Settled during appeal.

·          Sabedra v. Interlake Steamship Co., N.D. Ill., 1994: Represented shipowner in successful defense of

            non-jury Jones Act/unseaworthiness claim for exertional injury. Judgment affirmed on appeal.

·          Kurczewski v. Inland Lakes Management, Inc., E.D. Mich., 1993 (with Mrs. Brouhard): Jones

            Act/unseaworthiness claim by seaman who slipped and fell on icy deck, injuring his back.

            Verdict for plaintiff with finding of 50% contributory negligence.

·          Miller v. American President Lines, Ltd., N.D. Ohio, 1992: Portion of opening and medical direct and

            cross in "general" phase of reverse-bifurcated multi-plaintiff asbestos trial. Case never

            completed as to clients; defense verdicts for three clients of other firms and one relatively

            small plaintiff's verdict; see report at 989 F.2d 1450 above.

·          Lakatos v. Cement Div., National Gypsum Co., Wayne Cty. (Mich.) Cir. Ct., 1992 (with Mrs. Kelly):

            Sec. 905(b) claim by shipyard worker who fell on firehold ladder, suffering disabling injury to

            ankle. Defense verdict.

·          Walman v. Interlake Steamship Co., D.Minn., 1990: Defended against seaman's Jones

            Act/unseaworthiness suit for hearing loss allegedly caused by noisy turbine. Defense verdict.

·          Bishop v. Cross, N.D. Ohio, 1986: Defended civil rights action against police officers and their

            civilian relatives arising from unofficial eviction and ensuing fracas. Judgment n.o.v. in favor

            of clients.

·          Willer v. Twin Cities Towing Co., N.D. Ill., 1983: Defended against claim of seaman that waves from

            passing towboat caused him to fall while disembarking from workboat, causing fracture that

            eventually resulted in amputation. Defense verdict.

·          Saferstein v. Cleveland Clinic, Cuyahoga Cty. (Ohio) Common Pleas, 1978: Defended against claim

            by survivors of coronary care patient who died after being sedated in response to an acute

            psychotic episode and transferred to another hospital. Verdict for defendant.
