Reported Cases:

·          Connone v. Transport Desgagnes, Inc., 976 F.Supp. 1111 (N.D. Ohio 1996). Successfully defeated

            Lorain County Commissioners' motion for summary judgment and established that federal

            maritime law preempts state statutes granting political subdivisions immunity from suit.

·          New York Marine & General Insurance Co., et al. v. Total Petroleum (North America) Ltd., et al.,

            1997 AMC 1609 (E.D. Mich. 1995).

Unreported Cases:

·         Fermoile, et al. v. City of Lockport, New York, New York Supreme Court, County of Niagara, 1999.

            Represented plaintiffs in personal injury case for damages sustained when their pleasure boat

            struck an unlit water intake in the Niagara River; trial resulted in verdict for plaintiffs.

·          Fazio v. ULS Corporation, et al., U.S. District Court, E.D. Mich., 1999. Partial summary judgment for

            client in defense of personal injury claim, removing $2 million in speculative business losses

            from case; affirmed by United States Court of Appeals for the Sixth Circuit.

·          McCormack v. Cleveland Thermal Energy Corporation, Cuyahoga County Court of Common Pleas,

            1998. Represented plaintiff in personal injury case; trial resulted in a verdict for plaintiff.

·          State v. Koorey, Juvenile Court of Portage County, Ohio, 1997. Defended juvenile criminally

            charged with violating navigational rules resulting in a serious boating accident.

·          Fraser, et al. v. Smith, U.S. Dist. Court, N.D. Ohio, 1996. South Pacific offshore cruising contract

            dispute; damages in jury trial held to less than 10% of plaintiff's prayer. (2nd chair)

·          Aetna Casualty & Surety Co. v. Canada Maritime Agencies, Ltd., Cuyahoga County Court of Common

            Pleas, 1996. Summary judgment for client in cargo damage case on Hague Rules statute of

            limitations.

·          Spidle v. Regency Cruises, Summit County Court of Common Pleas, 1995. Summary judgment for

            client on personal jurisdiction issue.
